Dayna Steinfeld Profiled by Manitoba Bar Association

Dayna Steinfeld has been profiled in the upcoming Member Spotlight section of the Manitoba Bar Association’s Headnotes & Footnotes March 2024 publication. Dayna first became a member of the Manitoba Bar Association in 2009 and then rejoined after returning to Winnipeg in 2016.

Amanda Therrien Co-Hosts National Association for Women and the Law 50th Anniversary Reception

On February 29, 2024, Amanda Therrien will be co-hosting the National Association of Women and the Law’s 50th Anniversary Reception and Awards Ceremony on Parliament Hill, along with NAWL Executive Director, Tiffany Butler. Members of Parliament and Senators will join NAWL to honour the substantive contributions NAWL’s volunteers and partners have made toward advancing substantive equality for women over the past 50 years.

Raphaëlle Laframboise-Carignan to Present on Workplace Obligations

On February 15, 2024, Raphaëlle Laframboise-Carignan will be presenting on a panel hosted by the Law Society of Nunavut, titled “Workplace Obligations of Employees and Employers in Nunavut and Ontario”. The panel will discuss employment law in Ontario and Nunavut, including recent legal cases and changes in the law on workplace harassment, violence, and discrimination.

Dayna Steinfeld Awarded with 2022 Emerging Leader Award

Dayna Steinfeld has been awarded the 2022 Faculty of Law Alumni Emerging Leader Award by the University of Manitoba Faculty of Law.

The Emerging Leader Award honours a UM Law alumnus who has graduated within the last 10 years, has shown dedication and commitment to the legal profession, and has the qualities of integrity, professionalism, and leadership in their time practicing law. Read more about the award here.

CAF/DND Sexual Misconduct Class Action – Late Claims Update

The Court has made a decision respecting late claims, which can be found here.

The Court has decided that the Administrator shall accept late claims submitted after the final claims deadline of January 23, 2022, if the claimant establishes: (1) a continuing intention to pursue the matter; (2) the claim has some merit; (3) no prejudice arises from the delay; and (4) there is a reasonable explanation for the delay. The Court also noted that “the failure to establish one of the preceding criteria is not determinative as the real test is ultimately that justice be done between the parties”, but that “it will ordinarily be necessary for the claimant’s explanation to account for the totality of the delay, up to and including the date on which the claim is submitted”.

However, the Court held that the Administrator cannot accept any late claims beyond 30 days following this decision, being Sunday, February 5, 2023

  • If you already submitted your claim after January 23, 2022, you must provide reasons to the Administrator setting out how you believe you meet the above test as soon as possible, and no later than February 5, 2023. If you already provided an explanation for why your claim was late when you submitted it, you may want to update that explanation to ensure you satisfy the test above.
  • If you have not yet made a claim, but you wish to make a late claim under the Settlement Agreement in this action, you must submit your claim to the Administrator, as well as the reasons setting out how you believe you meet the above test, as soon as possible, and no later than February 5, 2023.

The Court held that, due to the need for finality and to close the administration process, February 5, 2023 is the ultimate deadline to file your materials with the Administrator and seek its approval to file a late claim.  This date cannot be extended.

Please note that the decision and the instructions below also apply to individuals seeking to add a category to an existing claim after the January 23, 2022 deadline.

James Cameron Moves Forward in Neutral Role

After more than thirty years at our firm, James leaves private practice to become a mediator/arbitrator. While this will benefit the employment and labour community at large, his presence will be tremendously missed at our firm.

James was a founding member of Raven Law. He successfully represented unions and their members throughout this period, including postal workers in a decades-long pay equity dispute that ended at the Supreme Court of Canada. More recently, James led our employment and disability practice groups. His body of work was recognized last year when he was inducted as a Fellow by the College of Labour and Employment Lawyers.

At the firm, James was committed to seeing other lawyers grow their own practices. He always had time to listen and mentor, through lunches, informal chats in offices or phone calls. And of course, his factoids. James seldom misses an opportuity to share little-known facts, to think about other things than work and to keep learning.

Every person at our firm benefitted from James’ skill and passion, mentorship and leadership.

Dayna Steinfeld to Moderate Panel on Pay Equity

On January 19, 2023, Dayna Steinfeld will be moderating a panel at the Manitoba Bar Association 2023 Mid-Winter Conference, one of the marquee professional development events in Manitoba. Dayna will be moderating a panel discussion on “Pay Equity in the Legal Profession”, which will feature a diverse panel of speakers on the data (and lack thereof, due to resistance to the collection of data within the profession) to help legal professionals in Manitoba understand pay (in)equity in the legal profession.

Topics will include the findings and recommendations in the Canadian Bar Association’s report on pay equity in the profession, compensation studies of in-house counsel, relevant legal considerations, and the role that legal employers, law societies, governments and lawyers can play in closing the gender pay gap and achieving pay equity in the legal profession.

RavenLaw Congratulates 2022 Alison Dewar Scholarship Recipient

RavenLaw is proud to announce that Sarah-Claude L’Ecuyer has been awarded the 2022 Alison Dewar Scholarship in Women’s Equality, Labour and Human Rights Law.

Sarah-Claude is in her third year at the University of Ottawa and has demonstrated a deep commitment to the values that Alison held dear. She is the President and founder of the Social Justice Society, an active volunteer with the National Association of Women and the Law, and her article on the First Nations Child and Family Caring Society case will soon be published in the National Journal of Constitutional Law. Congratulations, Sarah-Claude!

Alison McEwen Presents on Drug Use and the Workplace

On November 3, 2022, Alison McEwen spoke as part of Lancaster House’s 2022 Fall Webinar Series, presenting on the panel, “Going to Pot? Managing decriminalization, medical cannabis, and psychedelics”.

Alison and the other panelists provided an update regarding drug use and the workplace. This included discussing the move in B.C. to decriminalize possession of small amounts of certain illegal drugs for personal use, Health Canada’s changes which allow physicians to access restricted drugs to treat certain patients, and recent cases on medical marijuana use in the workplace context.
