Bijon Roy practices in the areas of human rights, administrative law, labour and employment law, and Charter litigation. He has acted in matters before the Canadian Human Rights Tribunal, Public Service Labour Relations Board, Canada Pension Plan Review Tribunal, Federal Court, and Federal Court of Appeal on behalf of public and private sector unions and employees, with emphasis on the federal public service.

 

Bijon has developed particular expertise in conducting research under access to information legislation, and regularly incorporates these skills into his litigation practice and other advocacy work.

 

While at law school, Bijon published articles in the University of Toronto Faculty of Law Review and Windsor Review of Legal and Social Issues, and served on the editorial board of the Journal of Law and Equality.

 

Bijon is actively involved in community radio, hosting a bi-weekly program exploring obscure and esoteric psychedelic music, and as Chair of CKCU’s Board of Directors.

 

Cases Bijon has worked on include:

  • Amnesty International Canada and British Columbia Civil Liberties Association v. Chief of the Defence Staff for the Canadian Forces, 2008 FCA 401 (Federal Court of Appeal) [applicability of Charter protections to detainees transferred by Canadian Forces to Afghan authorities; see the BCCLA's news release here]
  • Busch v. Canada (Attorney General), 2008 FC 1211 [judicial review of CHRC investigation into human rights complaint alleging discrimination in employment on the basis of national or ethnic origin]
  • Chopra v. Health Canada, 2008 CHRT 38 [see Canadian Human Rights Tribunal Finds Discrimination by Health Canada]
  • King v. Treasury Board (Canada Border Services Agency), 2008 PSLRB 64 [see PSAC Wins Significant Victory For Rights Of Union Activists]; 2009 FC 922
  • Desormeaux v. Ottawa (City) (2005), 54 C.H.R.R. 462; 2005 FCA 311 (Federal Court of Appeal) [employer's duty to accommodate absenteeism due to disability (migraine headaches); medical evidence of family doctor sufficient to prove a prima facie case]
